Terms and Conditions of Sale

1. Seller identification

These Terms and Conditions of Sale govern sales made on the Éditions Mergoil website.

2. Purpose

These Terms and Conditions define the rights and obligations of the parties in relation to the sale of books, publications and products offered by Éditions Mergoil.

Any order implies full acceptance of these Terms and Conditions.

3. Orders

Orders may be placed:

  • on the website www.editions-mergoil.com;
  • by post;
  • by email;
  • by purchase order for public bodies, libraries, universities, research institutions, laboratories and bookshops.

An order is considered final after payment validation or receipt of a purchase order.

Éditions Mergoil reserves the right to refuse or cancel any order in the event of a previous dispute with the customer or clearly incorrect information.

4. Product availability

Products are offered subject to stock availability.

Despite careful stock management, a product may exceptionally become unavailable after the order has been placed.

In this case, the customer will be informed as soon as possible and may choose either a full refund of the unavailable product or to wait for restocking where possible.

5. Prices

Prices displayed on the website are in euros, including VAT where applicable, excluding delivery costs.

Éditions Mergoil reserves the right to change prices at any time. Products are invoiced at the price in force at the time the order is confirmed.

Delivery costs are shown before final confirmation of the order.

6. Delivery costs

Delivery costs include preparation, packaging and shipping costs.

They are calculated according to the weight, volume, destination and selected shipping method.

The applicable delivery costs are those displayed when the order is confirmed.

7. Payment methods

Orders may be paid by:

  • credit card through a secure payment solution;
  • bank transfer;
  • cheque, when this option is available;
  • purchase order for authorised public bodies and professional customers.

Orders are shipped only after effective payment validation or receipt of the purchase order.

8. Delivery

Orders are shipped to the address provided by the customer when placing the order.

Delivery times are provided for information only.

Éditions Mergoil cannot be held responsible for delays attributable to the carrier or to force majeure.

Upon receipt of the parcel, the customer is invited to check its condition and immediately report any anomaly to the carrier.

Any claim relating to delivery must be sent to Éditions Mergoil as soon as possible.

9. Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, private customers have a period of fourteen (14) days from receipt of the products to exercise their right of withdrawal without giving any reason.

To exercise this right, the customer must notify Éditions Mergoil by post or by email at: contact@editions-mergoil.com

Return shipping costs remain the responsibility of the customer.

10. Returns and refunds

Returned books must be complete, in perfect condition, undamaged and suitable for resale.

Returns must be made using a shipping method with tracking.

After receipt and verification of the returned books, the refund will be made within a maximum period of fourteen (14) days using the same payment method as the original order, unless otherwise agreed.

11. Legal guarantees

Products sold are covered by the legal guarantees provided under the French Consumer Code and the French Civil Code.

Customers benefit in particular from the legal guarantee of conformity and the guarantee against hidden defects.

12. Liability

Éditions Mergoil cannot be held liable for damage resulting from improper use of the products sold.

Éditions Mergoil shall not be held liable in the event of force majeure, disruption of communication networks or events beyond its control.

13. Intellectual property

All books, illustrations, texts, photographs, logos and content distributed by Éditions Mergoil are protected by intellectual property law.

Any reproduction or distribution without prior authorisation is prohibited.

14. Personal data

Personal data collected when placing orders is processed in accordance with the Privacy Policy available on the website.

Customers have the rights provided for under the General Data Protection Regulation (GDPR).

15. Consumer mediation

In accordance with the provisions of the French Consumer Code, private customers have the right to use a consumer mediator free of charge for the amicable resolution of a dispute.

The contact details of the competent mediator are provided on request or once Éditions Mergoil has joined a mediation scheme.

16. Applicable law and disputes

These Terms and Conditions are governed by French law.

In the event of a dispute, the parties shall first seek an amicable solution.

Failing an amicable agreement, the French courts shall have jurisdiction.
